Terms & Conditions of Use of DGC’s corporate site and Cookies Policy – Member’s Login/Portal
This note (“EULA”) governs the relationship between you and Digital Gaming Corporation Limited (“DGC“) concerning your use of DGC’s software, systems, intellectual property rights and confidential information (collectively, “DGC’s System”) which are accessible via DGC’s official site at (“DGC’s Website”).
You confirm that you are, or are working with and/or on behalf of, one of DGC’s authorised customers.
DGC grants you a non-exclusive, limited licence to download and use the software and works in DGC’s System for the sole purpose of using these for ordinary licensed use as one of DGC’s authorised customers, or working with and/or on behalf of, one of DGC’s authorised customers. Any other use or copying of the software, works and any other intellectual property in DGC’s System is strictly prohibited.
All rights in the software, works and any other intellectual property in DGC’s System (including but not limited to artworks, video and audio assets, information and documentation) are the exclusive property of DGC or its licensors. You may not copy, decompile, reverse engineer, disassemble, modify, adapt, translate, or otherwise do anything to or with the software and works available in DGC’s System that is not strictly required for normal licensed use. The software and works in DGC’s System are valuable trade secrets of DGC, and you undertake not to disclose any information relating to the software and works that you may discover from reviewing, downloading or using DGC’s System. You have no transferable rights in DGC’s System. In particular, you are not permitted to sub-license, assign or otherwise dispose of the software and works in DGC’s System in any manner whatsoever, nor attempt to do so.
You agree that you will obtain, and at all times maintain, all necessary licences and consents and comply with all applicable laws, statutes, regulations and codes from time to time in force in relation to your use of all software and works in DGC’s System.
In no event will DGC be liable to you or any third party in contract, tort, negligence or otherwise for any consequential, direct, indirect, pure economic or incidental damages, nor any lost profits or lost savings, arising out of your or any third party’s access to, or use of, DGC’s System and DGC’s Website, even if a DGC representative has been advised of the possibility of such loss. You will be solely liable for any damage, costs or expenses arising out of or in connection with your use of DGC’s System and DGC’s Website. DGC does not warrant that your use of DGC’s System will be uninterrupted or error free.
Cookies, which are small files that websites save to your hard disk or to your browser’s memory, are used on DGC’s Website. Both session and persistent cookies are used. These will be used to authenticate users and prevent fraudulent use of user accounts. DGC also uses analytics cookies to track information how DGC’s Website is used so that improvements can be made. Analytics cookies may also be used to test new advertisements, pages, features or new functionality of DGC’s Website to see how users react to them. Finally, various third-parties cookies may be used to report usage statistics of DGC’s Website and deliver advertisements on and through DGC’s Website, including:
Google Analytics; Conversion Tracking; and Social Media Tools.
You have the ability to accept or decline cookies. Most Internet browsers automatically accept cookies, but you can usually modify your browser settings to decline cookies or to notify you when a cookie is being placed on your computer. If you choose to decline cookies, you may not be able to fully experience the features of DGC’s Website site or other websites that you visit.
DGC may terminate this EULA immediately without notice if DGC believes that you have breached any of the terms of this EULA or if your use of DGC’s System has been in any way improper or breached the spirit of this EULA.
DGC reserves the right to amend, modify, update and change any of the terms of this EULA and will notify you of any such amendment, modification, update or change. It remains your responsibility to ensure that you are aware of the correct current terms of this EULA and DGC advises you to check for amendment, modification, update or change on a regular basis. Your continued use of DGC’s System will be deemed to constitute your acceptance of any amendment, modification, update or change of this EULA.
If any part of this EULA is found to be invalid, void, or unenforceable, then the remainder of the EULA shall remain in force. This EULA shall be governed by English Law and the courts of England shall have exclusive jurisdiction over all disputes arising in connection with this EULA.
